Gore-Backed Automaker Secures $529M Taxpayer Loan
The federal government has loaned $529 million to Fisker Automotive Inc., a small car company backed by former Vice President Al Gore to help build a hybrid sports car in Finland that will sell for about $89,000, the Wall Street Journal reported.




Former Vice President Al Gore's campaign to save the planet from global warming has netted him a Nobel Peace Prize, an Academy Award and now $529 million in taxpayer money.
The federal government has loaned $529 million to Fisker Automotive Inc., a small car company backed by Gore to help build a hybrid sports car in Finland that will sell for about $89,000, the Wall Street Journal reported.
Fisker isn't the only automaker to reap millions from Uncle Sam. Tesla Motors Inc., which offers a $109,000 British-built electric Roadster, received a $465 million government loan. Tesla is a California startup that focuses on all-electric vehicles. It has won a number of celebrity endorsements and is backed by investors that have contributed to Democratic campaigns.
Critics question why vehicles aimed at the wealthiest customers are getting loans subsidized by taxpayers.
"This is not for average Americans," Leslie Paige, a spokeswoman for Citizens Against Government Waste, told the newspaper. "This is for people to put something in their driveway that is a conversation piece. It's a status symbol thing."
But Energy Department officials insisted that the loans were awarded only after a "detailed technical review" concluded the companies could eventually deliver a highly fuel-efficient hybrid car to a mass audience.
The government loans come from a $25 billion program established by Congress in 2007 to help automakers invest in the technology to meet a new congressional mandate to improve fuel efficiency. The Energy Department awarded the first $8 billion from the program to Ford Motor Co., Nissan Motor Co., and Tesla, which are all developing electric cars.

That's just one of the concerns Republicans say the Democratic-run Congress is ignoring in the rush to pass legislation to overhaul the nation's health care system.

Under the health care bill being considered in the Senate Finance Committee, Americans who fail to pay a penalty for not buying insurance could be charged up to $25,000 by the Internal Revenue Service or face up to a year in jail, according to congressional analysts.
That's just one of the concerns Republicans say the Democratic-run Congress is ignoring in the rush to pass legislation to overhaul the nation's health care system.
"The American people expect us to get this right and to do it in an open, honest and bipartisan debate. That's what they deserve," said Sen. Johnny Isakson, R-Ga., in his party's radio and Internet address Saturday. "But that's not what they're getting from the Democrats on Capitol Hill."
The Senate Finance Committee is the last of five committees to take up health care legislation, which tops President Obama's domestic agenda.
The committee chairman, Sen. Max Baucus, D-Mont., negotiated with top Republicans for weeks before talks broke down. Baucus' bill leaves out a primary demand of many Democrats -- a government insurance option -- and it has a lower price tag than other Democratic proposals.
But the legislation includes an individual mandate penalty that could go as high as $1,900. Thomas Barthold, chief of staff of the Joint Committee on Taxation, told senators that the IRS could take legal action against those who fail to pay the mandate penalty.
In a handwritten note to Sen. John Ensign, R-Nev., Barthold said violators could be charged with a misdemeanor and could face up to a year in jail or a $25,000 penalty.
Isakson and other Republicans say the Baucus bill is too costly and would require too much government intrusion into the health care system. Only one Republican, Sen. Olympia Snowe of Maine, appears to be considering supporting it.
At its core, the bill is designed to expand health insurance coverage to millions of people who lack it, employing a new system of federal subsidies for lower-income individuals and families and establishing an insurance exchange in which coverage would have federally guaranteed benefits.
Insurance companies would be prohibited from refusing to sell insurance based on a person's health history, and limits would be imposed on higher premiums based on age.

A video posted on YouTube appears to show a New Jersey elementary school class being taught to sing praises of the "great accomplishments" of President Obama.
The video shows nearly 20 young children taught a song overflowing with campaign slogans and praise for "Barack Hussein Obama," repeatedly chanting the president's name and celebrating his accomplishments, including his "great plans" to "make this country's economy No. 1 again.
The video identifies the kids as students at the B. Bernice Young Elementary School in Burlington, N.J., with taping taking place last June.
The song quotes directly from the spiritual "Jesus Loves the Little Children," though Jesus' name is replaced with Obama's: "He said red, yellow, black or white/All are equal in his sight. Barack Hussein Obama."
Among other lyrics, touting a fair-pay bill Obama signed in January: "He said we must be clear today/Equal work means equal pay."

The author of the full lyrics is unknown, but a woman -- possibly a teacher -- can be heard in the beginning of the video correcting and helping a student who has forgotten the words.
The office of the superintendent of Burlington Township School District did not provide comment or confirmation to FOXNews.com that the songs were recorded at B. Bernice Young Elementary when contacted by phone Thursday.
The video was originally posted Sept. 6, two days before Obama made an address to the nation's schoolchildren in which he praised the American education system as the best in the world and urged students to stay in school.
"At the end of the day, we can have the most dedicated teachers, the most supportive parents, and the best schools in the world," Obama said.

It was a WONDERFUL day! The news media, including Fox (I’m surprised) keep saying that the number of people was 10’s of thousands; but we were there….it was closer to 1 million! The police said they estimated 1.2 million and the British press is saying 2 million! Whatever the number it was definitely more than 30 thousand some are trying to say – so we are in good company with millions of people who think as we do!

It was great to see people who were part of the march EVERYWHERE we turned in DC. They were ALL OVER! We all talked with one another asking where the other was from and their story of how they got to DC. We met a nice man from Utah who flew out and a young couple with two little children who live in Orange County, CA (yes, where the Housewives of Orange County live) lol They felt the needed to fly out and be part of the movement. Another couple drove from Texas in their car…

Mark spotted a young woman who is on O’Reilly a lot (sorry, I forgot her name). She was very happy to hear Mark say that she looked skinnier in person!

We didn’t see any ACORN or SEIU people (thank God) so there was no violence and everyone listened to the police. I can’t describe properly how nice everyone was – it was such a great feeling to think we might still have a chance to preserve this great country. WE ARE NOT THE SILENT MAJORITY THAT THE MEDIA WANT US TO THINK WE ARE.

WASHINGTON - The Obama administration is preparing new rules that would give hundreds of prisoners being held by the U.S. military in Afghanistan the right to challenge their detentions, according to published reports.
The guidelines would for the first time allow about 600 prisoners held at an American-run prison at the Bagram Air Base to call witnesses and submit evidence in their defense, The Washington Post and New York Times reported in stories Saturday on the Web.
The guidelines came to light as the Obama administration is reviewing Bush-era detention policies and determining where to make changes.
The proposed rules were given to Congress in mid-July for a 60-day review and were expected to be made public this week.
Under the rules, prisoners would have military-assigned representatives charged with gathering evidence and calling witnesses on their behalf. That process is similar to the one used for detainees at the U.S. military prison at Guantanamo Bay, Cuba. Unlike those prisoners, the Bagram detainees have had no means to challenge their detentions -- some of which have stretched for years -- or to hear allegations against them.
Prisoners at Bagram have been refusing privileges like recreation time and family visits arranged by the International Committee of the Red Cross to protest their lack of legal rights since July, according to U.S. military and humanitarian officials.
Human rights campaigners have argued that the prisoners should be given the same rights as those at Guantanamo, but the U.S. military argues that Bagram detainees should be treated differently because they are being held in an active theater of war.
Their status is the subject of lawsuits in the United States. A federal judge ruled in April that several Bagram detainees have the right to challenge their detention in U.S. courts, and the Obama administration has asked a federal appeals court to overturn the decision.
Ramzi Kassem, a law professor at City University of New York and attorney for one of those Bagram detainees, said the move is just "window dressing."
"The whole thing was meant to pull the wool over the eyes of the judicial system," he told The Associated Press late Saturday, responding to the news reports. "These changes don't come anywhere near an adequate substitute for a real review."
Kassem said the changes appear to amount to a review by a military representative assigned to a detainee. The representative would not be bound by confidentality, thus making this system similar to one already rejected by the U.S. Supreme Court in 2008.
"These improvements are really just smoke and mirrors," Kassem said.
Kassem represents Amin al Bakri, a Yemeni national who was taken to Bagram after being detained in Thailand in 2002.
Efforts to get responses from administration and military officials were unsuccessful late Saturday.

Watching a replay of this terrible day was very difficult to see. One of the most sickening scenes was the poor people jumping to their death to get away from the flames. All I could think of is the way the Liberal Do-Gooders fault America for Water Boarding the people involved in all of this.
Ron was lucky enough to be in New Jersey that morning. if not he would have been in the middle of that horror. I was on the phone with him when he saw the 2nd plane hit the 2nd tower. It was visible on the N.J. side and not show live on TV yet. He told me later that he saw the people leaping to their death. It is still so unbelievable eight years later.
Too bad BO did not have dinner and theatre reservation for today. then he could have be in New York for the Memorial Services.

2 ACORN Employees Fired, Could Face Criminal Charges

An employee at ACORN's Baltimore office advises a couple posing as a pimp and a prostitute during a videotaped meeting in July.
The community organizing group ACORN has fired two employees at its Baltimore office who were seen on hidden-camera video giving advice to a man posing as a pimp and a woman pretending to be a prostitute, as some legal experts raise questions over whether the employees broke the law.
The staffers appeared to commit federal tax fraud by offering to help the visitors — for a fee — to establish a child brothel, legal experts say.
In a video made public Thursday, two visitors to an ACORN office in Baltimore told staffers they needed assistance securing housing where the woman, a 20-year-old who called herself "Kenya," could continue to run her prostitution business.
An ACORN official told the couple how to falsify tax forms and seek illegal benefits for 13 "very young" girls from El Salvador that they said they wanted to import as prostitutes.
Though no tax forms were filed and the child prostitutes didn't exist, the ACORN official engaged in "numerous acts of criminal facilitation," said Judge Andrew Napolitano, FOX News senior judicial analyst.

"Criminal facilitation occurs whenever a person encourages, enables, entices, or explains to another how to commit crimes with the real purpose of helping that person to commit those crimes" — a violation the ACORN employee "committed in full," he said.
Napolitano said the worker could also face charges for criminal conspiracy, though each charge would require a heavier burden to prove: a so-called "act of furtherance" — a concrete move that makes the conspiracy active.
Napolitano outlined eight crimes the ACORN worker could potentially have committed that could bring a total sentence of 24 years in prison, including criminal facilitation and conspiracy to:
• (a) commit prostitution
• (b) operate a prostitution ring
• (c) file false documents with taxing and other government authorities

• (e) violate numerous immigration laws
• (f) transport children into the U.S. for immoral purposes

• (h) impair the welfare of minors.
But not all legal experts agreed that ACORN had committed a crime. Trial attorney Lee Armstong said that the employee had engaged in "repulsive ... disgusting behavior," but nothing illegal occurred because the entire scenario was a sham.
"For aiding and abetting tax evasion, for aiding and abetting child prostitution ... you need the actual crime," said Armstrong, an attorney for Jones Day in New York. "That's what's missing here."
Armstrong said that the videotape appeared to show the ACORN official hatching a conspiracy, but no violation occurred because the 25-year-old filmmaker was only "pretending" to be a 25-year-old pimp.
"You need an actual agreement between two people to commit a crime. If one person is just faking it, you don't have a meeting of the minds, you don't have a conspiracy," Armstrong told FOX News. "How do you clap with one hand?"
ACORN — the Association of Community Organizations for Reform Now — calls itself a network of families "working together for social justice and stronger communities," according to its Web site.
But the organization has been accused by conservatives and Republicans of committing fraud in voter registration drives around the country, and reaction to the videotape came swiftly after its release on Thursday.
"Taxpayers should be outraged that their money has gone to an organization that, in addition to facing charges of voter fraud and tax violations, is willing to facilitate prostitution," said Rep. Steve King, R-Iowa.
"As this video confirms, ACORN continues to operate as a criminal enterprise."
In a selection from the video, ACORN officials treated the "pimp's" illegal schemes with nonchalance and offered to help further what they knew to be crimes.
"It's illegal. So I am not hearing this, I am not hearing this," said an ACORN staffer who identified herself as an accountant. "You talk too much. Don't give up no information you're not asked."
Because the group receives millions of dollars in federal grants, Napolitano said, "ACORN agents and employees are required by law to adhere to high standards of lawful and ethical behavior; standards akin to those required by law of federal employees."
ACORN suggested a plan of action for the purported pimp and prostitute, but did not fill out tax forms with any false information. But because the official sought a $50 fee for ACORN's services, a conspiracy charge could still be considered, a defense attorney told FOX News.
"Conspiracy requires an agreement to do something unlawful and an act in furtherance," said Mark Eiglarsh, a New York-based attorney. "There's an agreement to assist in creating the brothel, in tax evasion, a number of other offenses."
The act in furtherance, he suggested, could be the staffer's seeking payment for the work. "I think that a prosecutor ... would agree to go forward on a conspiracy count," he said.
Whether or not prosecutors charge any ACORN officials in Baltimore, the filmmaker himself could be in hot water.
A Maryland state statute requires consent from all parties whenever a conversation is taped, according to the Reporters Committee for Freedom of the Press. Violations of the law are punishable by a maximum of five years in jail and a fine up to $10,000.
But that statute does not apply to videotape recordings — only to phone calls or other electronic "communications," Napolitano argued — meaning the filmmaker is likely in the clear.
